Terms of Use

1. Scope of Application

These Terms of Use apply to the use of the Playmunity platform, operated by Dominik Hettich, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany (hereinafter "Provider"). They govern the use of the platform for free playing partner search (matchmaking) as well as the free mediation of training sessions, courses, and events offered by third parties.

2. Registration and Use

  • The use of the matchmaking service and the mediation of coach services is provided to users free of charge.
  • By successfully registering and creating a user account, the user accepts these Terms of Use.
  • Registration of a main account is restricted exclusively to individuals of legal age. However, adult users have the option to create so-called sub-accounts within their main account for minor family members (e.g., children) in order to register them for matchmaking or training sessions.
    By creating such a sub-account for minors, the adult holder of the main account confirms that they are the legal representative of the minor and explicitly consents to the processing of the child's data (e.g., first name, last name, age, playing strength) for the purpose of a player profile, matchmaking, and registration for training sessions in accordance with Art. 8 GDPR. The main account is fully responsible for all activities, communications, and bookings made via the sub-account. The holder of the main account explicitly undertakes to personally accompany the minor user to all real-world sporting encounters initiated via the platform or to ensure the continuous presence of an adult supervisor. The duty of supervision rests solely with the holder of the main account.

3. Services of the Provider (Playmunity)

  • Matchmaking: The platform provides a technical infrastructure through which users can search for playing partners, interact, and arrange real-world sporting encounters.
  • Mediation of Third-Party Services: The platform lists training sessions, courses, events, and services that are offered and conducted independently by third parties (in particular training schools, coaches, clubs).
  • No Own Contracts: The Provider itself does not provide any sports services or training. The platform acts exclusively as a free mediation portal.
  • The Provider reserves the right to change or further develop the services and features on the platform at any time, or to discontinue existing services in whole or in part.

4. User's Obligations to Cooperate

  • The user is obligated to provide correct, complete, and truthful information during registration and to keep their profile up to date.
  • Any health restrictions or special needs must be communicated to the respective playing partner or coach in a timely manner prior to the provision of the service (especially for training sessions and matches).
  • Users commit to interacting with each other in a fair, respectful, and sportsmanlike manner.

5. Contractual Relationship and Payments for Third-Party Services (Coaches)

  • Pure Mediation: When booking training sessions and other services from third parties via the platform, the contract is concluded directly and exclusively between the user and the respective third-party provider (e.g., coach).
  • Playmunity is not a contractual partner to these service or purchase contracts.
  • Payment Processing: No payments are made to Playmunity. All fees, charges, or costs for booked training sessions are to be settled directly with the respective third-party provider in accordance with their own terms and payment conditions.
  • Liability for the content, execution, quality, and safety of the training sessions lies solely with the third-party provider. Complaints are to be directed straight to them.

6. Termination of Use

  • The free user account can be deleted by the user at any time and without a notice period via the account settings.
  • The Provider is entitled to block or delete user accounts in the event of violations of these Terms of Use or applicable law.
  • For booked third-party services (training sessions), the cancellation and termination conditions of the respective third-party providers apply.

7. Liability

  • The Provider merely supplies the technical platform for matchmaking and coach mediation.
  • The Provider assumes no liability for the conduct of users during real-world sporting encounters, nor for any injuries, property damage, or disputes resulting from these meetings or training sessions. Participation is strictly at one's own risk.
  • The Provider is only liable for intent and gross negligence, as well as unconditionally for damages resulting from injury to life, body, or health based on a breach of duty by the Provider (e.g., due to technical malfunctions).
  • The platform assumes no liability for the accuracy of the information provided by users or coaches, nor for the actual availability of the mediated coaches.

8. Data Protection

  • The processing of personal data is carried out in accordance with the Privacy Policy.
  • Personal data is passed on to the respective playing partner or coach for the fulfillment of the contract as soon as a mediation or match is established.
  • Upon receipt of the data, the third-party providers (coaches, clubs) are independently responsible for complying with data protection regulations.

9. Copyrights and Rights of Use

  • All content, materials, and software codes provided on the platform are protected by copyright.
  • Coaches and commercial users may only use the platform within the scope of the intended mediation purpose. Any systematic extraction (scraping) of the database is prohibited.

10. Community Content and Code of Conduct

  • The platform allows users to create content such as posts, profile pictures, or chat messages.
  • The user undertakes not to post any unlawful, insulting, discriminatory, or sexually offensive content.
  • The Provider assumes no liability for user-generated content but reserves the right to remove content without comment in the event of violations of applicable law or these Terms of Use.
  • The user guarantees that they hold all rights to the posted content (in particular profile pictures) and do not infringe upon the rights of third parties.
  • By publishing, the user grants the Provider the non-exclusive right to use this content for display on the platform.

11. Requirements for Coaches and Third-Party Providers

  • Coaches, clubs, and schools offering their services on the platform must ensure upon registration that they:
    • (i) possess the necessary training and experience to provide the training professionally and safely,
    • (ii) comply with all applicable legal and tax regulations, and
    • (iii) have adequate professional or public liability insurance.
  • The third-party providers are obligated to guarantee the accuracy of their information and to independently monitor legal requirements. Playmunity does not conduct a substantive verification of the coaches' qualifications.

12. Final Provisions

  • The laws of the Federal Republic of Germany shall apply.
  • Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
